Mold
I'm now having a second occurrence of mold in my apartment. I scheduled for a mold inspector to come into my apartment on 9/4/20. Those results came back on 9/7/20. Just the count of mold in my 4 year old son's room was over 14,000 alone which is significantly over the base line. My apartment is at contamination level, containing aspergillus & penincillum The inspector sent over a letter of immediate remediation. He also recommended that my son and I don't stay in that apartment. My apartment is fairly new being that it was just built spring of 2019. I reported the mold, mold results, and sent over SC Law Section 27-40-440 concerning implied warranty of habitability, a month ago. The property manager scheduled an appointment with me that same week on Friday. She called me the day of and told me she would have to reschedule because they had an emergency offsite. I've attempted to contact both the property manager and the corporation over the apartments several times through the course of this time, by phone and by email. No one from neither entity has made any attempt to contact me over the course of this issue. I have asthma which has went from mild to moderate because of the mold. I'm struggling with my health. I've been in and out of the doctors. I've had to be prescribed several inhalers, machine to help me with breathing, and many other prescriptions. I've suffered 3 asthma episodes. One of those times happened after I spent 2 hours in my apartment. I've had pneumonia symptoms and was unable to go to work. My son had to get a blood test done to test for the mold and the hospital social worker got involved due to the fact that we haven't been living in habitability conditions. This event is taking a toll on my son and I emotionally. My son cries almost daily because he's unable to go home to his room and play with his toys. His behavior has changed. My anxiety is at an all-time high and I'm fighting to not fall into a depression. We're basically homeless because due to my health conditions my doctor doesn't want me staying in that apartment. We've been living on couches of family members. I've also informed the property manager and corporation of that as well. All of our stuff is damaged. I managed to save a handful of clothes. But everything else including furniture, shoes, electronics, clothes, personal items, my son's toys, and toy bin are ruined. I have several pictures, videos, and more of everything. Everything is getting worse by the day. We cannot bring anything else out of that apartment. They've shown no morale, no professionalism, and no care to remediate or fix this issue. They have breached the lease and is now well over the allotted time to remediate. I'm afraid, my son is struggling, and I don't know what else to do or where to go. This is the first time I've ever dealt with anything like this. This is my first apartment. It's now been over a month since I informed GEM management about this issue. No remediation has been done in the apartment. I've tried several times to communicate with them. I finally spoke with the regional director on October 8, 2020. The first thing she said to me on the phone was accuse me of hanging up wet clothes in the closet, and that being the reason for the wide spread of toxic black mold throughout the apartment. I informed her that I've NEVER hung up wet clothes in the apartment. She also went on to say that they would "let" me out of my lease without charging me and that I should consider charging my damaged items to insurance. They have breached the lease. I have spoken with DHEC and was told to report them to the housing authority, the media, and more. By law, I'm within my rights to withhold my rent if my apartment isn't livable. They still put a late notice on my door, as if it's my responsibility to pay rent for a contaminated apartment, that I have been unable to live in. We have to vacate and have nothing to take with us but several health issues, due to their negligence
